1. Introduction
This Legal Policy ("this Policy”) governs the use of Okra Shopping Mall ("the Online Platform”), an online marketplace enabling Merchants to set up and list their stores on the Online Platform and accords customers the opportunity to purchase Products from the Merchant’s stores listed on the Online Platform. By accessing or using the Online Platform, either as a Merchant, customer or user, you agree to comply with and be bound by the terms set forth herein.
2. Purpose and Objectives
This Policy aims at establishing a framework for managing legal risks, ensuring compliance with applicable laws and regulations, and promoting a safe and secure online shopping environment for customers, Merchants and stakeholders.
The Online Platform’s objective is to ensure confidentiality, integrity and availability of customer data. Further, to foster a fair and competitive business environment and to comply with applicable laws and regulations, including those related to e-commerce, competition, consumer protection, and intellectual property.
3. Scope of Application
This Policy applies to all customers who use our Online Platform, all Merchants who set up and list their stores on the Online Platform.
4. Definitions
- Online Platform: Refers to the Okra Shopping Mall platform enabling Merchants to sell Products to customers.
- Merchant: An individual or entity registered on the platform to list and sell Products.
- Customer: An individual or entity purchasing Products listed on the platform.
- User: Anyone who accesses, browses, or uses the platform in any capacity.
5. Responsibilities
Users
Users must comply with applicable laws, provide accurate information, keep login details confidential, and avoid fraudulent or unlawful activity.
Merchants
- Must follow guidelines and list Products accurately.
- Ensure Product compliance with safety and legal standards.
- Prohibited from selling illegal, counterfeit, or hazardous goods.
- Liable for any losses from defective or unfit goods.
- Handle disputes, clearly communicate return/refund policies.
Customers
- Must provide accurate delivery details and pay for orders.
- Can track orders via the Online Platform.
- Resolve disputes directly with Merchants, with platform assistance if necessary.
6. Terms of Use
Merchant Account Registration
Merchants must create an account and provide business details. Registration implies agreement to the Platform’s terms.
Customer Account Registration
Browsing is allowed without an account, but purchasing requires registration with personal and payment info.
Payment Processing
Payments are securely processed. Funds are transferred to the Merchant within 48 hours, less applicable commissions.
7. Data Collection
Personal data is collected for order processing, communication, and platform improvement.
8. Third–Party Services
The Platform may provide access to third-party services. Use of these services is at the user’s risk, and users must read relevant terms. The Platform disclaims liability for third-party service issues.
9. Feedback and Reviews
Feedback is encouraged but not treated as confidential.
10. Privacy Protection
User data is handled per the Privacy Policy, which users accept by using the Platform.
11. Termination
The Platform may suspend or terminate accounts for policy violations, including removing stores or cancelling transactions.
12. Severability
Invalid provisions are severed without affecting the validity of the remaining provisions.
13. Governing Law
This Policy is governed by the laws of the Republic of Zambia.
